These Terms of Service (“Terms”) govern your use of the Wissel Trucking website (the “Site”) and the services offered by Wissel Trucking (“Services”). By accessing our Site or engaging our Services, you agree to comply with and be bound by these Terms. Please read them carefully.

2. Services

Wissel Trucking provides excavation, grading, pond construction, drainage solutions, gravel driveway installation, material hauling, and retention pond maintenance services primarily in Washington, Morton, East Peoria, Pekin, Eureka, and surrounding Central Illinois communities.

3. Site Content

3.1 Ownership

All content on this Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations, is the property of Wissel Trucking or its content suppliers and is protected by United States and international copyright laws.

3.2 Use Restrictions

You may access, view, download, and print content from our Site for your personal, non-commercial use only. You may not:

4. Estimates and Quotes

4.1 Project Assessment

Estimates provided by Wissel Trucking are based on our assessment of project requirements at the time of evaluation. Actual project costs may vary based on conditions encountered during work, changes in project scope, or other factors not apparent during initial assessment.

4.2 Validity

Unless otherwise specified, written estimates are valid for 30 days from the date of issuance.

5. Service Agreements

5.1 Contract Formation

A binding agreement for Services is formed when you accept our written estimate or proposal by signing a service agreement or providing other explicit confirmation.

5.2 Schedule

Project timelines provided are estimates. While we strive to meet all projected schedules, actual completion times may vary due to weather conditions, unforeseen ground conditions, material availability, or other factors beyond our control.

5.3 Change Orders

Any modifications to the agreed-upon scope of work must be documented in a written change order signed by both parties. Change orders may affect project cost and timeline.

6. Payment Terms

6.1 Deposits

Larger projects typically require a deposit before work commences. The specific deposit amount will be outlined in your service agreement.

6.2 Final Payment

Unless otherwise specified in the service agreement, final payment is due upon completion of the project.

6.3 Late Payments

Payments received after the due date specified on the invoice may incur a late fee of 1.5% per month on the outstanding balance.

7. Cancellation Policy

7.1 Client Cancellation

If you cancel a scheduled service with less than 48 hours’ notice, a cancellation fee may apply to cover preparation costs already incurred.

7.2 Weather-Related Delays

Wissel Trucking reserves the right to reschedule work due to weather conditions that would compromise project quality or safety. No cancellation fees will apply in such circumstances.

8. Warranties

8.1 Workmanship

Wissel Trucking warrants that all Services will be performed in a professional manner in accordance with generally accepted industry standards. Specific warranty terms vary by project type and will be outlined in your service agreement.

8.2 Materials

Materials used in our projects carry the manufacturer’s warranty. Wissel Trucking does not provide additional warranties for materials beyond those provided by manufacturers.

8.3 Limitations

Our warranty does not cover damage resulting from:

  • Improper use or maintenance
  • Acts of nature including but not limited to floods, tornadoes, or earthquakes
  • Alterations by anyone other than Wissel Trucking
  • Normal wear and tear
  • Conditions beyond our control

9. Liability Limitation

9.1 Property Conditions

Wissel Trucking is not responsible for underground or hidden objects not marked by utility companies or not disclosed by the client prior to commencement of work.

9.2 Maximum Liability

To the maximum extent permitted by law, Wissel Trucking’s liability for any claim arising from our Services shall not exceed the amount paid for the Services giving rise to such claim.

9.3 Indirect Damages

In no event shall Wissel Trucking be liable for any indirect, special, incidental, or consequential damages, including but not limited to loss of use, loss of data, loss of income or profit, or loss of or damage to property.

10. Indemnification

You agree to indemnify, defend, and hold harmless Wissel Trucking, its officers, directors, employees, agents, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from your violation of these Terms.

11. Privacy Policy

Our Privacy Policy, which explains how we collect, use, and protect your personal information, is incorporated into these Terms by reference.

12. Modifications to Terms

Wissel Trucking reserves the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Site. Your continued use of the Site or our Services following any changes indicates your acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any principles of conflicts of law. Any dispute arising under or relating to these Terms or our Services shall be resolved exclusively by the state and federal courts located in the State of Illinois.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with any service agreements or other written agreements between you and Wissel Trucking, constitute the entire agreement between you and Wissel Trucking with respect to your use of our Site and Services.
